Who we are

1st Call Accident Management Ltd is the data controller for the information described in this notice. We are registered in England and Wales, company number 17378559, at Unit 9 Birch Court, Crystal Drive, Smethwick, West Midlands B66 1RB.

What information we collect

  • Your name, address, telephone number and email address
  • Details of the accident, including date, time, location, circumstances and photographs
  • Vehicle details, including registration, make, model, mileage and condition
  • Driving licence details and driving history, where a replacement vehicle is provided
  • Insurance details for you and for the other parties involved
  • Details of the other driver, their vehicle and any witnesses
  • Correspondence between us, and notes of telephone calls
  • Payment and account information where charges are involved

We do not ask for information about injuries, medical treatment or health. We do not handle personal injury claims.

Where we get it from

Most of it comes from you directly. We may also receive information from your insurer, the other party insurer, recovery operators, repairers, independent engineers, garages that refer you to us, and publicly available sources such as the DVLA vehicle enquiry service.

Why we use it, and our lawful basis

  • To provide our services – recovery, storage, engineering, repair management, replacement vehicle provision and claim correspondence. Lawful basis: performance of a contract with you, or steps taken at your request before entering one.
  • To recover charges from the responsible party – presenting and supporting the vehicle-related claim. Lawful basis: our legitimate interests in recovering sums properly due.
  • To run and protect our business – record keeping, fraud prevention, quality checks, insurance and dealing with disputes. Lawful basis: our legitimate interests.
  • To meet our legal obligations – accounting, tax, and responding to lawful requests. Lawful basis: legal obligation.

Who we share it with

We share only what is necessary, and only with parties involved in your claim or in running our business:

  • Your insurer and the insurer of the other party
  • Vehicle recovery operators and storage providers
  • Independent engineers and approved repairers
  • Solicitors or agents instructed in connection with the vehicle claim
  • Our accountants, auditors, insurers and professional advisers
  • Our IT and communications suppliers, who process data on our instructions

We do not sell your information, and we do not pass it to anyone for their own marketing.

How long we keep it

We keep claim files for six years after the file is closed, which reflects the period in which a claim or dispute can normally be brought, and longer where we are required to for legal or accounting reasons. Records that are no longer needed are securely deleted or destroyed.

Where your information is held

Your information is held on systems within the UK or the European Economic Area. If that ever changes, we will make sure appropriate safeguards are in place before any transfer.

Your rights

Under UK data protection law you have the right to ask us for a copy of your information, to have inaccurate information corrected, to ask us to delete information we no longer need, to restrict or object to how we use it, and in some cases to receive it in a portable format. To exercise any of these, contact us using the details above. We will respond within one month.

If you are unhappy with how we have handled your information you can complain to the Information Commissioner Office at ico.org.uk or on 0303 123 1113. We would ask you to raise it with us first so we have a chance to put it right.

We review this notice regularly. Any changes will be published on this page with a revised date at the top.
